Bombay High Court lifts stay on Kunal Kohlis Phir Se

Times readers Get FREE $30 to spend on Amazon, Walmart…Few weeks ago, Kunal Kohli found himself in the eye of a storm when writer Jyoti Kapoor filed a suit against the Kohli for copyright infringement stating that the story of Kunal's film Phir Se was inspired by one of her scripts. Post the filing, the court had levied an interim stay on the release of the film Phir Se featuring Kunal Kohli and Jennifer Winget. However now we hear that the Bombay High Court has vacated the interim stay on the release of the film.

In a judgment passed by the appeal bench presided over by justices V M Kanade and B P Colabawalla, the court vacated the interim stay granted by a single bench of the high court few months ago on the film's release after it found prima facie similarities between this film's script and another movie R.S.V.P. However, the court has also directed Kohli to deposit a sum of Rs. 50 lakhs within two weeks as security and will hear at length a suit filed by writer Jyoti Kapoor alleging copyright infringement and breach of confidence against Kohli and production house Bombay Film Company.

For the uninitiated, Jyoti Kapoor had filed a complaint with the FWA and Indian Motion Pictures Producers Association (IMPPA) and also issued a notice to Kohli after she found out about the film Phir Se that apparently bore stark similarities to a script she had written and shared with Kohli back in 2010. Post this, a Joint Dispute Settlement Committee of IMPPA issued notice to Kunal Kohli directing him to stop shooting of the movie Phir Se till the matter is resolved. However despite the notice from IMPPA, Kohli went ahead with the shooting of the movie. Following this, Kapoor approached the high court.

On the other hand, Kunal Kohli maintained that the setting, the treatment and the climax of the film Phir Se were completely different from R.S.V.P.
