NBGS Legislative Assembly Impeaches Caretaker Governor

In a heated motion that took place in the assembly hall on Monday, the legislators challenged the legibility of the Caretaker Governor whom they have accused of 9 charges including embezzlement, fraud and unconstitutional steps taken by the Governor since he took over the position.

A letter by members of the assembly reads in part that, “We the legislators of Northern Bahr el Ghazallegislative assembly do hereby pass a vote in support of the impeachment of the Caretaker Governor for;

“Awarding the letter of credit [LC] contract to his son Bol Kuel Aguer that is worth 3,000,000 USD. Unconstitutional appointment of 12 advisors which is contrary to NBGS constitution article 105. Giving loans of 1.5 million USD without the approval of the assembly which breaches state constitution article 102-1 and NBGS appropriation Act of 2014/2015 section 7, subsection 3. 3. Diversion of  funds for the months of November and December 2014 to his premature campaign for 2015 general elections, which is an offence according to NBGS appropriation Act 2014/2015 section 4 subsection 2.” 

He was also accused of incitement through speeches he made in public.

Out of 49 members in the State Legislative Assembly, 42 attended the heated deliberation in the assembly hall of which, 34 members voted in support of the impeachment. 4 members were absent and 2 on official sick leave.

The Speaker who was the chair of assembly opted for neutrality as he was to ensure that the motion is procedurally in order as he observes the motion.

Only 8 lawmakers out of 49 voted against the move saying the procedures were unconstitutional but the majority of the members who voted in favor of the decision defended the result to be endorsed. 

Speaking on behalf of the impeaching team, the assembly spokesperson Hon. Achak Thiep defended the procedures that were taken to impeach the Governor saying it was constitutional. 
“The procedures were constitutional and legal because we took into consideration all legal aspects into this matter and after referring to this counts, the decision in reference to constitutions both national, state and appropriation Act; were convincing evidences to impeach the Caretaker Governor for these proofs.” 

However, the Press Secretary to the Caretaker Governor, Angelo Wol Mawien Dut differed with the assembly’s chairperson.

“Legally, the decision taken by the assembly was inconsiderable and questionable in the legal aspects because the Governor was falsely accused of all those charges without proof which was something initiated politically to remove him. On this juncture, we are waiting for the response from the national leadership; otherwise this will be challenged in the court of law.” 
Governor Kuel was absent during the deliberations. He is in Juba for the National Liberation Council’s consultative meetings.

This is not the first time NBGS legislative assembly is impeaching a member of the SPLM party in the state. The Former Minister of Finance, Ronald Ruay Deng, was impeached in 2011, Hon. Athiang Manok, former Deputy Speaker in the state legislative assembly was impeached in 2013, former speaker of the assembly Hon. Monicah Achol William Amuoi who now occupies the cabinet affairs’ ministry was also impeached a month ago.
