Charges have been filed against a suspect in the fatal shooting of a man and wounding of two others at 7429 Long Point on Oct. 21, 2010.

The suspect, Joe Munoz (H/m, DOB: 4-27-86), is charged with capital murder in the 209th State District Court. Munoz, currently in the Harris County Jail on an unrelated charge, is accused in the death of Nicolas Martinez, 33, of the above address. Mr. Martinez suffered multiple gunshot wounds and died at the scene. A photo of suspect Munoz is attached to this news release.

Two other men were wounded and transported to Ben Taub General Hospital with non life-threatening injuries.

HPD Homicide Division Sergeant M. McStravick and Senior Police Officer P. Vela reported:

Mr. Martinez saw a male suspect breaking into his vehicle in the apartment complex parking lot and left his apartment to confront the suspect. Martinez was followed by his two brothers and an altercation ensued between Martinez, his brothers and the suspect. During the altercation, the suspect pulled a gun and shot Martinez and his brothers. The suspect then fled the scene.

Shortly after this incident, Munoz was stopped by HPD patrol officers and arrested for his involvement in a previous unrelated robbery. A follow-up investigation and witness statements positively identified Munoz as the shooter in this case. He was charged on Monday (May 9) and remains in custody.
