Four suspects arrested after a shootout with police in Houston, Texas

Charges have been filed against four suspects arrested in a burglary during which a fifth suspect was wounded by a Houston police officer at 181 West Dyna about 1 a.m. on Friday (Nov. 5).

The suspects, Albert De La Cruz (H/m, DOB: 12-28-90), Jose Guadalupe De La Cruz (H/m, DOB: 4-13-93), Joe Angel Rodriguez (H/m, DOB: 1-28-92) and Max Nieto (H/m, DOB: 6-20-90), are charged with burglary of a building in the 228th State District Court.

A fifth suspect, a 16-year-old male, suffered gunshot wounds to the arm and leg and was transported Ben Taub General Hospital where he was treated and released. He was not charged in this incident.

Officer B.R. Baker, who discharged his duty weapon, was not injured in the incident. Officer Baker, assigned to the Gang Division, was sworn in as an officer in May 2003.

HPD Homicide Division Senior Police Officer R.A. Swainson and Officer C.D. Sturdivant reported:

While patrolling the Greenspoint area, Houston police officers interrupted a burglary in progress at an audio store located at the above address. While arresting the suspects, one suspect failed to heed the officers’ verbal commands to show his hands and instead appeared to be reaching for a gun at his waist. The officer, fearing for his safety, discharged his duty weapon, striking the suspect.

As is customary in HPD officer-involved shooting incidents in the city limits, this case is being investigated by the HPD Homicide and Internal Affairs Divisions and the Harris County District Attorney’s Office.
