The Ontario judge who wore a Donald Trump campaign hat into court the day after the US election, Justice Bernd Zabel, is off the bench since the stunt. BBC revealed to have confirmed from a spokesperson of the court that Justice Zabel has no longer been assigned any case since 21 December.

The incident took place on 9 November, when Justice Zanbel wore the red hat to the court and placed it on the bench near him during the proceedings of the day. The incident ensued numerous formal complaints over his conduct suggesting that he implied lack of impartiality. Thereafter, a spokeswoman for Ontario Court Chief Justice recently confirmed that the Hamilton, Ontario, judge has not been assigned to preside in court last month. Justice Zabel’s office refrained to comment on the story. However, he had earlier apologized on 15 November in an open court for wearing the “Make America Great Again” hat as he confessed that “what I did was wrong.” He alleged that “I wish to apologise for my misguided attempt to mark a moment in history by humour in the court room following the surprising result in the United States election.” He claimed that wearing the hat was not meant as a political statement or as an endorsement of President-elect Trump’s policies.

According to a report, Justice Zabel mentioned in court about the hat at the time that it’s “just a celebration of an historic night in the United States.” The Criminal Lawyers’ Association (CLA) is one of the organisations that has filed formal complaints with the Ontario Judicial Council against the judge for wearing political paraphernalia on the bench.
