In a widely applauded B.C. Supreme Court ruling, Justice Mark McEwan found three of four Hells Angels associates accused in the slaying, guilty of manslaughter on Friday. Slain Kelowna’s dad, Dain Phillips, applauded the decision in outburst. In response to the clapping, judge told a packed Vancouver courtroom to “knock that off, I don’t want any more of that.”

The judge found accused Daniel McRae guilty of being a party to the June 2011 fatal beating of 51-year-old Phillips. In addition to him, Judge McEwan also found McRae’s brother, Matthew McRae, and a third man, Anson Schell, guilty of manslaughter. Meanwhile, a member of a support club of the notorious motorcycle gang, Robert Cocks, was acquitted from all charges. A statement issued by the victim’s wife, Jeannie, said that “we are very happy with the outcome and are looking forward to putting this behind us.” She added that “we would like to commend the Kelowna RCMP and the Crown counsel team for all their hard work and doing such an excellent job on a difficult case.”

Cocks’s son and a full-patch member of the Hells Angels, Norman Cocks, and another full-patch member Robert Thomas, had already pleaded guilty to the manslaughter of Phillips. The Court was told that Norman Cocks and Thomas had severely beaten Phillips using baseball bats and hammers and the two McRae brothers, Schell and Cocks, kicked Phillips while he was lying on the ground following the baseball bat and hammer assault.
