Judge Acquits Both Doctors Accused of Gang Sex Assault Charges

Superior Court Justice Julie Thorburn has announced to have found the two 36-year-old doctor, Dr. Amitabh Chauhan and Dr. Suganthan Kayilasanathan, not guilty of sexually assaulting and drugging a 23-year-old medical student three years ago in a downtown Toronto hotel room. The long-sought ruling was delivered before a packed courtroom on Thursday morning.

In her remarks, Thorburn stated that although there was reasonable doubt that the woman did not consent to sexual encounters that night, there is no admissible evidence to support the Crown’s assertion that the doctors planned to drug and sexually assault the woman. Thorburn highlighted that the woman seems to be in full command of her faculties in a hotel security video shot soon before the alleged assault. Dr. Chauhan and Dr. Kayilasanathan were charged with gang sexual assault and administering a drug with intent to stupefy in 2011. Whereas, both accused pleaded not guilty to all charges at the start of the judge-alone trial in April and testified that the sexual contact that did occur was consensual.

Earlier, Chauhan was also acquired of additional charges including sexual assault and drugging an ex-girlfriend in a fall 2003 incident in Kingston. At the time, Chauhan completely refuted that the incident ever took place, and proved that he was not in Kingston on the weekend. Whereas, the woman testified that the alleged sexual assault did took place. The identities of both women are covered by a publication ban.
