Since an appeal court judge decided to reserve judgment on Michael Sona’s bail hearing on Friday, he will have to spend another weekend in the Maplehurst Correctional Complex. Sona was moved to the maximum-security detention centre in Milton, Ont., on Nov. 19 after being sentenced to nine months for his role in an election-day robocalls addressed to hundreds of voters in Guelph in order to steer them to wrong polling stations.

According to Sona’s appeal lawyer, Howard Krongold, the notice to appeal the sentence and the conviction was filed this week. During his imprisonment since almost 10 days, Sona released a statement through a friend that he is innocent of the crime. In his remarks, Krongold urged Justice Harry Laforme to release Sona on bail because if he stays in prison until the appeal is heard, it will be too late. He said that “this is a sentence appeal that will almost certainly be moot by the time the appeal is heard.” Additionally, Krongold pointed out that since there are no precedents in sentencing for Elections Act offences, the sentence needs to be reviewed.

Whereas on the other hand, federal prosecutor, Nick Devlin, admitted that it is appropriate for the appeal court to consider the sentence, but argued that Sona should be behind bars till the appeal goes on. He said that “he broadcast a lie for political gain,” adding “instead of stealing his victims’ money, he tried to steal their vote, and succeeded in doing so.”
