Judge Gives Last Instructions to Jury in Luka Magnotta Case

A 12-member highly reported jury has finally reached the time to make a final decision regarding the fate of accused sex killer, Luca Rocco Magnotta, in a case that evoked two months of testimony regarding a May 2012 incident. At the time, Magnotta killed and dismembered the body of a Chinese exchange student to send her different body parts to different notable personalities via postal service.

In his final instructions, Justice Guy Cournoyer advised the jury on Monday morning that “you must consider and make your decision without sympathy, prejudice or fear.” The jury has been sent off to decide whether Magnotta is guilty of first-degree murder or not guilty because of a mental disorder. Quite noticeably, Magnotta did not testify in his own defence and rested his head in his hands during the final phase of the trial. According to Magnotta’s lawyer, Luc Leclair, he has confessed to have murdered Jun Lin in the early morning hours of May 25, 2012, but he did it in the midst of a psychotic episode. Leclair alleged that Mangnotta believed at the time that he was under surveillance and that Lin was part of a plot against him.

In his final remarks, Cournoyer informed the jurors that “you must not find Mr. Magnotta guilty unless you are sure that he is guilty,” and stressed that “even if you believe he is probably guilty or likely guilty, that is not sufficient.”
