Soumitra SenNew Delhi: According to the TV reports, President Pratibha Patil has accepted the resignation letter of Calcutta High Court Justice, Soumitra Sen and has sent to the Law Ministery for further actions. The Law Ministry will send it to the Lok Sabha for the permission.

Earlier, Soumitra Sen sent his resignation letter in written to Pratibha Patil, raising the fresh issues that whether impeachment proceedings against him in Lok Sabha on Monday. "A lawyer on behalf of justice Sen has handed over a resignation letter to the President this morning. The President is perusing it," a Rashtrapati Bhawan Spokesperson said on Saturday without disclosing details.

The sources said that, the resignation of Soumitra Sen is on process of doing all the formalities. A person who is involved with the constitutional entity has the authority to resign from his assigned designation. In the Indian Constitution, there is rejection involved and the resignation given by a constitutional entity under hand and tackle to the President comes into effect immediately.

Sources said that the President after scrutinize the letter will hand it over to the department of Justice for further appropriate action. A judge may by writing under his hand addressed to the President resign his office. After reports that Justice Sen had sent his resignation by fax to the President, Attorney General G E Vahanvati decided on Friday that the prosecution process should continue.

The Government’s top law officer is learnt to have sharp out that since the resignation letter is ‘not in proper format’, it could be discarded by the President and by stopping accusation proceedings at this stage, would allow Justice Sen to continue.
