A name that was unknown to many has surrounded the new Narendra Modi government with yet another controversy. Gopal Subramanium, is a top lawyer who was considered and then called to become one of the judges at the Supreme Court of India by the Chief Justice of India RM Lodha himself. Unfortunately Subramanium could not enjoy the honor for long as the Modi government returned the recommendation with a request to reconsider this decision.

Subramanium was shocked and disappointed with the silence of the Supreme Court collegium on the government’s response to the names it had recommended.  Subramanium stated the government’s action as an impediment to the independence of the judiciary and informed the media personnel that he was invited to become a judge though he had never expressed the desire to become one. “I was invited to be a judge. I was not longing to be a judge. Having accepted the invitation to be on the bench, I wanted to do some good work.” In a nine page letter to the Chief Justice RM Lodha, Subramanium wrote: “I am fully conscious that my independence as a lawyer is causing apprehension that I will not toe the line of the government. This factor has been decisive in refusing to appoint me. I have no illusion that this is so.”

“I am not here to offer myself for continuous scrutiny. I have established my credibility. Intelligence Bureau cleared my name on May 15. I don’t want any character certificate from anyone except myself,” Subramanium told reporters at his office.
