A 24-year-old man has pleaded guilty and been sentenced following an investigation into the 2009 homicide that took place at the Pacific Mall in the City of Markham.

On Tuesday, August 27, 2013 Bryan Gardner appeared before Regional Senior Justice Brown of the Superior Court of Justice and pleaded guilty to Second Degree Murder. He was sentenced to life in prison in connection with the death of Chun Kit (Daniel) Cheong. Gardner will not be eligible to apply for parole until August 2026. Gardner also received a 10-year firearms prohibition upon his
release.

On Friday, February 20, 2009, at approximately 8:45 p.m., York Regional Police and Emergency Medical Services personnel responded to the XSITE Cell Phones store located in the Pacific Mall at 4300 Steeles Avenue East in the Town of Markham for a weapons call. Officers located a male victim on the floor of XSITE with gunshot wounds. The victim was transported to hospital with life-threatening
injuries. He was later pronounced dead.

The victim was identified as Chun Kit (Daniel) Cheong, 26, of Toronto and a post-mortem examination revealed that he died of a single gunshot wound to the head.
