Vader’s Lawyer Seeks New Info after Arrest, Retrial Ordered

The suspect accused in the murder of Lyle and Marie McCann but released on $25,000 bail, Travis Vader, has once again been arrested and placed under house arrest. According to his lawyer, Brian Beresh, they are still trying to figure out what new information or evidence has led to the arrest and retriggered the murder trial.

Lawyer Beresh stated that “I have no information about any new evidence whatsoever,” admitting to have been caught off guard when Travis Vader was arrested on Dec 19. According to Brian, he’s now hunting for new information that has led the crown to believe that a prosecution will be successful. He said that “we’re asking for an explanation as to why this was done, this very unusual procedure in a serious case like this.” Whereas on the other hand, crown prosecutor, Ashley Finlayson, confessed that “it’s rare” because “I’m aware of certainly 3 or 4 or a couple in the last five years, but it is rare, it does happen.”

42-year-old Vader was re-arrested on first-degree murder charges last week. He was originally charged in 2012, i.e. two years after Lyle and Marie McCann were last seen fueling up their motor-home in their hometown of St. Albert. However the initial charges were stayed earlier this year just before trial. Upon inquiry about what has changed since, Finlayson said that it “depends what you mean by new,” explaining that “there’s additional material because time has passed. Beyond that I can’t comment on what information there is.”
