An Ottawa couple was recently served an eviction notice to a couple, asking them to vacate their home after neighbours complained about their son, who has autism, for making too much noise running around in their condo. The eight-year-old child named Logan from uses his trampoline for behaviour therapy. His parents, John From and Kerri Oastler, claim that his noise stops at the time he goes, which is usually 9 p.m.
Mr. From mentioned in a stated issued to media reporters, saying that “I’m not angry anymore, I’m just sad about the whole situation, and I just found it was really mean.” The building management company of Mr. From, City View Property, has mentioned in the legal notice that the noise originating from the apartment interferes with “reasonable enjoyment of the residential complex,” while serving the family with a seven notice to control the noise, or they’ll be served with an eviction notice. From claims that that’s “pretty much to correct the noise, we would have to get rid of Logan.”
On the other hand, the management company claims that it is only giving warning in advance because “details of the disability had not been disclosed to the landlord.” Though, Mr. From claims that he mentioned it clearly that Logan has autism and is a “bouncy kid” who’s going to “generate a little bit more noise.” Mr. Form is now planning to file a complaint with the Human Rights Commission, whose website claims that “people cannot be refused an apartment, bothered by a landlord or other tenants, or otherwise treated unfairly because of their disability.”
