Bail plea of former military ruler Pervez Musharraf in the judges’ detention case has been turned down by an ant-terrorism court in Islamabad. Special judge Kausar Abbas Zaidi heard arguments from both sides and decided to reject the application.
Ilyas Siddiqui, counsel for Musharraf, argued that the allegations leveled against his client were unfounded. He maintained that the former president did not pass any orders to detain the judges, and if the orders were passed, they should be produced before the court as evidence. He insisted that if the orders cannot be produced before the court, the allegations remain baseless. Lawyer Siddiqui also highlighted that section 6/7 of the Anti-Terrorism Act was not applicable in this case; hence, the court should grant his client the requested bail.
On the other hand, public prosecutor Aamir Nadim Tabish emphasized that the allegations against Musharraf are extremely serious and sensitive. He accused the former military ruler of imposing emergency in Pakistan and held him responsible for detaining 60 judges, including Chief Justice Iftikhar Muhammad Chaudhry.
Lawyer Tabish quoted the lines from ex-PM Yousuf Raza Gilani’s speech, saying that he had used the word ‘release’ while ordering the restoration of judges. Tabish maintained that the speech proves the judges had been in detention earlier. The prosecutor insisted that the case falls in the category of terrorism and bail should not be granted.
Considering the arguments presented from both sides, the court decided to cancel the plea on Wednesday.
