Keeping the kids safe from predators’ currently has just under 5,000 ‘likes’ on Facebook, but will now be closed after the plaintiff won his High Court Case.
Ruling, Mr. Justice McCloskey said: “Society has dealt with the plaintiff in accordance with the rule of law.
“He has been punished by incarceration and he is subject to substantial daily restrictions on his lifestyle.”
The man was jailed for six years for child sex offences committed more than two decades ago, including indecent assault, gross indecency with a child and inciting a child to commit an act of gross indecency.
The unnamed offender, found his photo published on the website – alongside threatening comments – following his release from prison on licence.
He claimed the publication of his personal details amounted to harassment, misuse of private information, and breached his right to privacy and freedom from inhuman or degrading treatment.
Although Facebook has already removed his photo and the harassing comments made, his legal team still insisting the page to be shut down with the disclosure of the identity of page admins.
Lawyers for Facebook have argued that it was neither necessary nor proportionate to remove a page having 4,000 likes.
However, plaintiff gets the ruling in his favor after Mr. Justice McCloskey has balanced the competing rights to privacy and freedom of expression.
