Widow of John Simon settles lawsuit against RCMP

Disputes between the RCMP and widow of John Simon have now been resolved. Patsy MacKay and Simon’s mother filed a court case against a Mountie, who allegedly killed Simon in his home on the Wagmatcook First Nation reserve in Cape Breton around three years ago.

RCMP was sued by Simon’s widow for loss of financial support, companionship, and mental anguish. According to RCMP spokeswoman Sgt. Brigdit Leger, the matter has been settled.

She said: “Near the end of December, the RCMP had settled a lawsuit with Mrs. MacKay and Mrs. Bernard. As the amount and the terms of the agreement are subject to a non-disclosure agreement, I can’t offer any additional comment regarding the terms of the settlement.

“Being the police service provider for the community of Wagmacook, the RCMP still works closely with community, the band, the council. That provides us an opportunity to discuss any ongoing policing issues or concerns and try to reach a resolution as soon as possible.”

She also said the RCMP wants to strengthen its ties with people in Wagmatcook, and is considering of holding a memorial dinner in the memory of late Simon.

44-year-old Simon was shot dead by Const. Jeremy Frenette at his home in response to another resident’s call informing police that Simon was allegedly drunk, suicidal and armed. An inquiry carried out by the Halifax Regional Police concluded there was no wrongdoing by the officer.

However, public inquiry later conducted by the Commission for Public Complaints Against the RCMP found errors in judgment and decision-making led to the tragedy.
