Magnotta’s Lawyer Quits Due to an Alleged Conflict-of-Interest

The preliminary hearing of Luka Rocco Magnotta’s case reconvened in court on Wednesday morning, while the victim’s father, Jun Lin, failed to return after leaving the courtroom in tears a day earlier. The legal team of Magnotta was also enforced to carry on with one lawyer short, since the attorney stepped down due to revelation of a possible conflict of interest. The lawyer, Raphael Feldstein, decided to quit the cause due to an issue raised by the Crown. The details regarding the alleged conflict, along with any other evidence provided during the preliminary hearing, are covered by a publication ban.

Daran Lin, father of the alleged victim, was shaky and crying before he departed on Tuesday, however, the family’s lawyer assured that Lin, who has came especially from China to take part in the proceedings, will likely return later this week. On the third day of hearing, Magnotta wore big black glasses and a black shirt, while appearing to be actively listening to the proceedings. Feldstein pulled out from the proceedings voluntarily in the afternoon even before both sides began debating on the matter.

Meanwhile, Magnotta is still adequately defended by the remaining two lawyers, namely Toronto-based Luc Leclair and Montreal criminal attorney Pierre Panaccio. The preliminary hearing has so far heard from three more police witnesses until the third day of hearings at the Montreal courthouse. The scheduled three-week long hearing will decide on whether or not there is sufficient evidence to send Magnotta to trial.
