Family Sues School Board, Teacher over Student’s Death

Family members of the Ottawa student, Eric Leighton, who died in a shop-class explosion almost two years ago, have filed a $400,000 lawsuit against the Ottawa Catholic School Board and a teacher. 18-year-old Eric was a student at Mother Teresa Catholic High School. He passed away on May 26, 2011, after using a hand grinder on a steel drum in shop class as part of a project to make a barbeque. Unluckily, a spark ignited the gas inside the drum, which was previously filled with flammable peppermint oil, resulting in a potentially fatal explosion that cost one life and injuries to many.

The statement of claim filed by Leighton’s parents, Patrick and Sheri Leighton, sister Kaitlyn and grandparents, Allan and Gale Deering, on May 23, claims that the school board and a teacher, Scott Michael Day, were to be held responsible in the boy’s death. The claim enlists almost 19 failures of the board and teacher, alleging that the defendants should have been aware of the potential danger of doing hot work on a barrel that once contained a combustible gas. The family has filed claim of damages for the loss of care, guidance and companionship had Eric Leighton not died.

It was noted that Patrick Leighton failed to return to work for three months after Eric’s death, while Sheri Leighton was kept on a short-term and then long-term disability through her employer’s insurance plan as a result of inconsolable grief and shock. The report added that they attempted to return to work following Eric’s death but failed.
