Beaches-East York MPP Michael Prue’s popular Bill 49, which bans business owners and management from taking the tips earned by their employees, passed second reading today. This is Prue’s third attempt to see this Bill becomes law.
Many restaurants, both chains and sole proprietorships, follow this unfair practice of forcing workers to share a portion of their tips with owners. Prue’s research shows anywhere from .5% to 4% of servers’ tips go directly to owners. Some, Prue has heard, take 100% of servers’ tips. Restaurant servers and bartenders earn only $8.90 an hour, far below the minimum wage.
Former server Amanda Barchard is pleased the Bill has a chance of becoming law.
“The passing of Bill 49 means that policy makers have finally recognized the serious problem of tip theft by owners,” said Barchard. “On behalf of Ontario’s hospitality workers, I would like to thank Michael Prue and the NDP for making this issue known and for establishing the amendment to the Employee Standards Act that will protect our tips today and into the future. We look forward to serving you!”
“I am grateful that my colleagues across party lines have stood with me. I hope that the government will act quickly and ensure that the Bill is called to the committee for swift passage without delay,” said Prue following the vote.
