The case of an attempted arrest of a man by police officers at a Toronto G20 protest, in which he was allegedly thrown to the ground and got injured, was heard in court day. The suspect, 30-year-old Adam Nobody, denied allegations that he was violently resisting the arrest while the officers attempted to handcuff him. Officer’s defence lawyer, Harry Black, inquired from Noboday that “you had succeeded in getting to your knees and you were trying to get away.” He added that “all six foot, 220 pounds of muscle were trying to get those officers off your back.” Although Nobody stated that he did not do anything else other than instinctively defending himself, or blocking blows, since five or six officers were roughly tackling and beating him alone.

Black’s client, 33-year-old Const. Babak Andalib-Goortani, has pleaded not guilty to the charges of assaulting Nobody with a weapon, his nightstick. Const. Andalib-Goortani has not been accused of having caused the facial injuries suffered by Nobody, including a broken nose and shattered cheekbone, but the issue at hand is whether or not he used lawful force.

During his testimony in court, Nobody stated that he was riding his bicycle to the Queen’s Park in order to attend what, according to his knowledge, was a designated G20 protest zone. He reported to have been a victim of police aggression, alleging that he was chased by riot-gear clad officers, who slammed him to the ground and struck repeatedly with kicks, blows and batons. Nobody was inquired by Black, as he questioned that “did you attempt to bite an officer’s hand?” He replied “absolutely not.”
