The Toronto police officer charged with second-degree murder in the shooting death of Sammy Yatim on a Toronto streetcar in July, Constable James Forcillo, has agreed to surrender himself into SIU custody on Tuesday morning. An official press release by the SIU issued on early Monday afternoon revealed that Mr. Forcillo is scheduled to appear before a justice of the peace at Old City Hall on Tuesday, August 20.

Mr. Forcillo’s lawyer, Peter Brauti, revealed that the initial appearance is scheduled at 9 a.m. and then a bail hearing is expected to be scheduled later on, while emphasizing that it will take place “as soon as possible.” Mr. Brauti explained that “it’s a matter of court time,” elucidating that “it could happen tomorrow, it might happen a week from now.” He alleged not to comment any further until the bail hearing is completed. Meanwhile, the SIU refrained from providing any details into the location of the officer’s arrest due to his safety, as the press release states, “because Const. Forcillo has been the recipient of threats, we are not disclosing the location of the arrest.”

The charges have resulted from an incident in which Mr. Yatim was shot nine times by police for allegedly brandishing a three-inch knife on the westbound Dundas streetcar near Trinity Bellwoods Park. The incident took place at around midnight on July 27, at a time when Mr. Yatim was alone in the TTC streetcar as all the passengers and the driver had already fled the vehicle unharmed.
