Legal Experts Raise Concerns over Toronto Cop Forcillo’s Speedy Bail

Criminal defence lawyer, Leora Shemesh, raised concerns over Const. James Forcillo’s bail hearing that took place on Tuesday as it was allegedly labeled as “the quickest bail hearing I’ve ever seen.” Concstable Forcillo, was charged with second-degree murder by the SIU in the shooting of Sammy Yatim on Monday, he later ended up surrendering on Tuesday morning, unusually soon after which, he appeared for bail hearing on the same afternoon. Shemehsh highlighted that “he’s a police officer and I guess that according to this city, he’s entitled to special treatment.”

Leora Shemesh pointed out that usually bail hearings of murder cases are heard in the Superior Court of Justice, and often the Crown is allow to take up to three days for preparing a bail hearing, though even more time can be granted with the co-operation of the defence. Semesh stated that “a regular accused would be taken to Old City Hall, been detained, been in jail and would have to wait for a date in the Superior Court to have his bail hearing. But in this case they sort of bypassed or took the VIP line to the Superior Court.” She added that “there is a special procedure in place for police officers, and everybody knows that.”

Apart from the super quick and ready-to-go bail granting to Constable Forcillo, legal experts seem satisfied over the course of events before that. It was disclosed that laying of second degree charges by The Special Investigations Unit on Monday, issue of a warrant and a secret surrender were all standard procedure.
