Brian MILLER, age 26, of Pakenham, Ontario has been charged with impaired driving and driving with in excess of 80 mgs of alcohol. He was released from custody and is scheduled to appear in court on August 25, 2010.
The 28-year-old male victim has since succumbed to his injuries. His name is being withheld at the request of the family.

It has come to be known that that victim and Brian were best of friends. We pray that victim’s family forgives Brian for the horrible tragedy. Brian will be tortured and haunted by the memories of his good friend dying in front of his eyes. It is a debt that Brian can never pay back. As Jeff died that night I am sure Brian dies every night.

Jeff Draper loved being the host.
It was no different Saturday when the 28-year-old Kinburn man planned a bachelor party for a friend: a day of golf, a home-cooked meal and a night out in the city.
However, the party ended in tragedy when an ATV that Draper was driving hit the back of a riding lawnmower during the early hours of Sunday.
A little more than one day later, Draper died in hospital from head injuries.
"Jeff was in a completely different category from anyone else," said friend Matt Trueman, 27, who grew up with Draper in Arnprior. "What a wonderful person he was. He was extremely caring, he was good at anything he did."
Trueman said the group of about 10 friends visited a few clubs in Ottawa on Saturday night and later returned to Draper’s house. Some went to sleep, while others stayed up.
"I was asleep when it happened; we all ran out and we tried to revive Jeff and do what we could until the ambulance arrived," he said.
Draper had been thrown from the ATV he was driving.
Draper was not wearing a helmet at the time, said Const. Brian Dodds of the Ottawa Police Collision Investigation Unit.
Police arrested the man who was allegedly driving the lawnmower. Brian Miller, 26, of Pakenham is charged with impaired driving and driving over the legal alcohol limit. He is scheduled to appear in court on Aug. 25.
More than 40 of Draper’s friends and family members gathered at the Civic campus of the Ottawa Hospital to support one another on Monday, said Arnprior town councillor Eric Burton, who also grew up with Draper.
"The support that was there for the Drapers was really a testament to Jeff’s character," Burton said.
Draper’s organs were donated and those close to him said hospital staff told them they saved the lives of five people.
"Those people better be prepared to turn into The Hulk. (Draper) was strong, mentally and physically," Trueman said.
He added that Draper liked playing a variety of sports.
"Jeff liked to do it all. He enjoyed hunting, fishing, he was very active, he enjoyed motor sports."
The two often used to ride their ATVs "wherever and whenever" they could, Trueman said.
Earlier this year, Draper and a team of three others won a sports competition created by a group of 32 of his high-school friends for fishing and golf.
Draper had been living with his girlfriend in a house he built last summer with his father and older brother.
"He was the most talented man I will ever know," Trueman said.
