The Alberta government has charged Calgary-based internet sales company GreatCarsandTrucks.com for misleading consumers about its services and refund guarantee.

“Alberta’s Fair Trading Act makes it illegal for businesses to deceive consumers,” said Heather Klimchuk, Minister of Service Alberta, responsible for consumer protection. “There can be serious consequences for companies that refuse to follow the rules, including stiff fines and even jail time.”

The company contacted people who placed ads in auto sales publications and promised it could sell their vehicles online within 90 days or consumers would get a full refund. Consumers paid between $100 and $200 to advertise on the company’s site, but the company allegedly refused to give the money back when the vehicles did not sell.

Service Alberta received numerous complaints about the company from consumers in Alberta, Ontario and the United States. The investigation involved other consumer protection agencies including Canada’s Competition Bureau and the U.S. Federal Trade Commission.

GreatCarsandTrucks.com (registered as 1171616 Alberta Ltd.), director Audrey Schmid and principal operator Craig McMorran are each charged under the Fair Trading Act with:

  • seven counts of representing consumer rights and remedies that did not exist;
  • seven counts of representing that services will be supplied within a stated period when there is no intention to do so; and,
  • seven counts of misleading or deceiving consumers.
