In his first appearance before a judge after facing a retrial on charges that he murdered his young children, Guy Turcotte, was presented in court today. He mostly kept his eyes to the floor when his former wife, Isabelle Gaston, entered the Saint-Jérôme courtroom, as he deliberately did not look in her direction at all. The next date in the case was set for Jan. 10, about which prosecutor Rene Verret alleged that it will be used to fix a trial date.

Since this is the second trial where Turcotte is facing same murder charges, a preliminary inquiry will not be required. Both brother lawyers representing Turcotte, Pierre and Guy Poupart, were present in court for the brief hearing and had no comments. Verret alleged that defence has not decided whether they will challenge the Court of Appeal decision ordering a new trial or not. Verret alleged that according to his knowledge, the second trial will be held in Saint-Jérôme even though assembling a jury whose members don’t have an opinion on Turcotte might become a challenge there.

Although he revealed that it’s up to the defence, if they chose to file a motion asking that they want the trial to be held in another jurisdiction. Verret also added that it is up to the defence to file a motion, in Quebec Superior Court, if Turcotte wants to seek a release between now and Jan. 10. 41-yaer-old Turcotte is charged with the first-degree murders of his children, 3-year-old Anne-Sophie and 5-year-old Olivier, on Feb. 21, 2009, in Piedmont.
