The Supreme Court this Thursday reinstated the Pakistan Tehreek-e-Insaaf (PTI) candidate, Qaisar Jamal Khan as a Member of the National Assembly (MNA) from the area of NA-47. The election commission had declared the elections NA-47 of FATA (Federally Administered Tribal Areas) void after Khan’s rival candidate Haji Abid Afridi had filed a petition on the bases of ‘the printing of wrong election symbol for a candidate in the ballot paper and corrupt practices.’
The election commission had declared on the 5th of May that Qaisar Jamal’s victory was voided and thus given a statement of carrying out another new election. The tribunal of Dera Ismail Khan was headed by Yahya Zahid Gillani. This case was heard at the apex court today where a two member bench headed by Justice Sarmad Jalal Usmani heard the case declaring the PTI candidate ineligible to hold his seat as a Member of the National Assembly.
The Supreme Courts session ended with the declaration that the election tribunal’s decision to de-seat Khan was illegal and he should restore his seat as MNA for NA-47. The Supreme Court also issued notices to the concerning parties and has further adjourned the next hearing for two weeks.
