A petition has been filed by Advocate Mohammad Azhar Siddique demanding disqualification of Yousaf Raza Gillani from the position of Prime Minister of Pakistan. It was filed to the Supreme Court on Thursday.
According to the filed petition, Mohammad Azhar Siddique has requested the court that a convicted man cannot work in the capacity of the Prime Minister of the country and therefore the current PM of Pakistan Yousaf Raza Gillani must be removed from his post. Adding to his request put forward, he also said that it is not for the Speaker of the National Assembly or the presiding authority of the Election Commission of Pakistan to decide whether the PM stays or resigns. They have absolutely no concern with the case whatsoever.
Siddique said that the Prime Minister was deemed disqualified as soon as Article 63 (1) (g) was enforced on him, which he explained is a “self executor provision” and does not require implementation via “any subordinate legislation or through Article 63 (2) or Article 63 (3) of the Constitution.” The petition also mentioned that “It is a case forfeiture of sacred trust proposed in the prime minister and in the Cabinet by entire population of the country and therefore, the prime minister and Cabinet has lost their right to rule as held in 1972 SC 139 (182).”
Azhar Siddique had submitted the disqualification of PM plea to the High Court in Islamabad earlier on Thursday. However, the court raised a few objects after which he altered his plea and submitted it to the apex court later in the day.
