The appointment of former Prime Minister Raja Pervaiz Ashraf’s son-in-law as the Deputy Managing Director, Pak-China Investment Company (PCIC) has been ruled illegal by the Islamabad High Court on Monday.

The Chief Justice Islamabad High Court (IHC), Justice Muhammad Anwar Khan Kasi, labeled the termination of Javed Mehmood and appointment notification of Shahnawaz Mehmood as DMD on March 4, 2013 as unlawful.

The Finance Ministry and PCIC’s counsel justified the appointment by stating that the said post was not statutory post, hence the government had free right to terminate or appoint any person any time at PCIC. The High Court found the argument invalid stating that appointment and termination is linked to the economic life of a person that could affect the fundamental right.

The former DMD Javed Mehmood had challenged the appointment of Shahnawaz Mehmood. He informed the court that his appointment as DMD of the PCIC was valid for three years, starting January 01, 2011. PCIC is a private limited company with shares of Pakistani Government and the Chinese banks while it has only one slot of the DMD with PCIC. The counsel for the petitioner insisted that it was a political appointment and urged the court to invalidate it.

On the other hand, former Prime Minister Raja Pervez Ashraf is alleged to be involved in a PKR 9 billion scam relating to two under-construction road projects in his constituency (NA-51). The Islamabad High Court (IHC) will take the matter at hand on Tuesday.
