The murder that occurred during the fall of 2010 at Mountain Institution in Agassiz now has a first-degree murder charge approved.

On November 23, 2010,upon hearing an alarm from a cell in the morning, staff entered the two-person cell and discovered one of the two inmates deceased. Staff of the institution secured the cell and removed the other inmate to another location.

The Integrated Homicide Investigation Team was called by the Agassiz RCMP to conduct an investigation as the death was determined to be suspicious.

The deceased inmate was identified as 33-year-old Jeremy Michael PHILLIPS.

The five-month investigation involved a great deal of interviews with both institution residents and staff, along with results from the RCMP Forensic Lab. Once investigators were in possession of all the facts and evidence, they presented a report to Crown Counsel who approved a charge of first-degree murder.

Charged with first-degree murder is 45-year-old Michael Wayne MCGRAY. MCGRAY remains an inmate of Federal Corrections; he is currently not housed in British Columbia.

It is not certain as to when MCGRAY will make his first appearance in Chilliwack Court or whether it will be in person or by video.
