Toronto man sentenced to 15 months for sexually abusing a boy

A 37-year-old man who previously pled guilty in connection with a 2009 sexual assault has been sentenced to 15 months, after a trial that lasted six days.

On Tuesday, June 14, 2011, James POWELL, 37, of Toronto, appeared before The Honourable Michelle Fuerst of the Superior Court of Justice and was ordered to serve 15 months in jail after being given six months credit for pre-trial custody and restrictive bail conditions. He has also been ordered to provide a mandatory DNA sample and will be listed on the National Sex Offender Registry for a period of 20 years. For a 10-year term, Mr. POWELL is not to attend at any daycare centre, school ground, community centre or public swimming area where children under the age of 16 are likely to be or seek employment or volunteer work involving children under the age of 16.

Mr. POWELL previously pleaded guilty on Friday, October 29, 2010, to one count each of Sexual Assault, Sexual Interference and Forcible Confinement. On Monday, May 11, 2009, at approximately 3:30 a.m., officers responded for a report of a sexual assault at the service centre located off of the northbound lanes, at 12001 Highway 400, north of Major Mackenzie Drive. They received information that a 13-year-old boy had been sexually assaulted in the men’s washroom while his father waited for him in the lobby. They boy was not physically injured.
