Ottawa Withdraws Request to Delay Judgment of Sixties Scoop Case

The federal government has withdrawn its request to delay the decision of an eight-year-old legal case between Ottawa and the indigenous people. The plaintiffs in the case have claimed that they were deprived of their cultural identity when removed as children from their homes on reserves and placed with white families.

The lawyers of the plaintiff’s were furious earlier this week when a Justice Department lawyer, Barney Brucker, wrote to Justice Edward Belobaba of the Ontario Superior Court for a meeting to discuss a possible delay of the judgment in the in the $1.3-billion Ontario “Sixties Scoop.” The court had set Feb. 15 as the date to deliver its decision.” In response to Brucker’s letter, Justice Belobaba declined the request for the meeting and asked the federal lawyers to explain in writing why the decision should not be read.

However, Mr. Brucker refrained from sharing the reason for the request to delay the order and instead asked Justice Belobaba on Friday to rescind his previous request. According to Mr. Brucker, “the commitment of the Government of Canada is to pursue a robust and expedited process of reconciliation for the whole of the country, with aspects touching upon a co-operative engagement of provinces as well.” However, Mr. Brucker continued in the letter that “in view of the plaintiff’s understandable desire to obtain a legal decision without further delay, we will respect their choice and will not be proceeding with a motion requesting an abeyance of your decision.”
