PM Harper says the federal government is not thinking of changing its stand on same-sex marriages, regardless of a government lawyer’s submission that a same-sex marriage in Canada is null and void if the couple does not reside in Canada.

Harper said: “When we first came to office we had a vote on this issue. We have no intention of further reopening or opening this issue.

“I am unaware of the details. This I gather is a case before the courts where Canadian lawyers have taken particular positions based on the law. But I will be asking officials to provide me with more details.”

On the other hand, lawyer Martha McCarthy asserts that a federal government lawyer has filed a submission stating that if same-sex marriage has taken place in Canada, its legitimacy depends on the law of the jurisdiction where the couple resides.

The uncertainty on the topic arose when a federal government lawyer in a lesbian divorce case stressed that the validity of same-sex marriages rely upon the laws of the country that couple the has been residing in.

McCarthy said: “[I was] very surprised… Fell off my chair surprised. I hope [the federal government lawyer’s] position is not successful. If it is it will be a significant embarrassment to us all. Embarrassment…to us as a nation, who have been a leader in equality rights for gays and lesbians since this issue became an international one.”
