Algo Mall Owners Request Secrecy of Inquiry Documents from Public Eye

The owners of the mall which dissembled in northern Ontario this summer have requested to keep some of their public inquiry documents a secret from public. Such a request was also made by the principal professional engineering association related to the complaints, as disciplinary action is taken against the two engineers related to the case of the Algo Centre Mall.

Usually such documents are believed to be connected with the proceedings and form an eminent part of public record. A lawyer even threatened that secrecy can undermine all the hearings. The inquiry is headed by Commissioner Paul Belanger, who has notified the participants and media lawyers that they are at least entitled to a make submission objecting to the confidentiality demands. A media lawyer, Paul Schabas, asserted on Tuesday that “this may go right to the root of the inquiry” and “If there are issues about the competency or conduct of engineers, the confidentiality issues could go right to the heart of the purpose of the inquiry.”

Both mall owners, Robert Nazarian and his son Levon, have mentioned in the application that they have be submitted very sensitive financial statements to the commission, so are requesting to keep them out public’s eye. Belanger stated that “there is a high expectation of privacy in relation to personal financial information” and “applicants seeking funding must be forthright and provide the commission with a clear picture of their net worth.” Belanger said. “In my view, their evidence is wholly deficient.”
