NHLPA Postpones ‘Disclaimer of Interest’ Case

The negotiations between the NHL and NHLPA are ignited once again, even though the executive director of NHL Players’ Association, Donald Fehr, claims there is “still a ways to go if an agreement can be reached.”

It is in fact a good news that the negotiations are back on their feet, which implies that union is no longer intending to file the disclaimer of interest against league any soon. The disclaimer suit will immediately dissolve union. Fehr has declined to comment on the players’ decision regarding the dissolution, while NHL commissioner Gary Bettman confirms that no such disclaimer of interest case was filed against the league even after the union’s self-imposed deadline of midnight Wednesday. Bettman asserted on Thursday that “the word disclaimer has yet to be uttered to us by the Players’ Association.” He added that “I know there’s been a lot of confusion about a disclaimer. It’s not that it gets filed with a court or the [National Labor Relations Board] when you disclaim interest as a union. You notify the other side. We have not been notified.”

On the other hand, Fehr stated that “all I can tell you about that is the players retained all the legal options they always had.” Both, Fehr and Bettman, have the same point of view regarding the negotiations as they share that some real progress has taken place in some key issues. NHL and NHPLA will both resume the negotiations session at 10 a.m. on Thursday morning again. Fehr states that “we will consider where we are in the morning.”
