Almost t 30 minutes after a crime scene investigator started his testimony at the preliminary hearing in the Magnotta case, Lin Jun’s father started weeping and was escorted out of the courtroom by his lawyer. The evidence presented in the case against alleged killer, Luka Rocco Magnotta, is routinely placed under a publication ban and cannot be reported. Due to the heartbreaking sobs of Lin Darin, the judge decided to break for lunch.

Magnotta was attentively present at the hearing, however, he did not illustrate any sort of emotion during the testimony. He was seated in the prisoner’s box with his arms folded. The court has placed an interpreter beside him for translating the testimony into English. Testimony will resume proceeding at 2 p.m. Earlier on Tuesday, Quebec Court Judge, Lori-Renée Weitzman, refused the request of not allowing members of public or the media to attend the preliminary hearing. Magnotta is facing charges of first-degree murder and dismemberment of a Chinese student, Lin Jun.

Magnotta’s lawyer, Luc Leclair, requested on Monday that a ban of public and media personnel from the courtroom due to the high-profile nature of the case. The media challenged the request, asserting that a publication ban is adequate to make sure that Magnotta receives a fair trial. Weitzman ruled that defence have failed to convince the court that allowing the public in the courtroom will infringe on Magnotta’s right to a fair trial. However, a publication ban prevents reporting on the evidence.
