Toronto Police Lays Charges of Sex Tourism on Canadian Citizen

In a one-of-its-kind case in hands of Toronto Police Service, it embarked upon a case against a Toronto man charged for offences of children abuse and pornography that allegedly took place in Cuba. The charges were initially laid on March 8, which have been made public now, against 78-years-old James McTurk of Toronto. McTurk has been indicted with multiple charges including one count each of making child pornography, invitation to sexual touching, and committing an indecent act. He also faces six counts of sexual interference too.

Later on July 24, 2012, charges of possession of child pornography were also laid against McTurk. It was alleged that he was found in possession of the material recorded between May 18, 2011 and July 11, 2012. An investigation found out that the sexual offences had actually taken place in Cuba, where the suspect allegedly travelled frequently for this purpose. Finally, the charges were laid against McTurk, with consent from the Attorney General as law guides us to seek consent of the federal justice minister or an attorney general of a province or territory before chaining someone with sex tourism offences.

The Criminal Code of Canada states that if a sexual offence is allegedly committed by a Canadian citizen or a permanent resident of Canada outside the country, these offences will be considered to have taken place in Canada purposes of launching a prosecution. It was reported that McTurk has a history of multiple convictions of possession of child pornography which dates as back as 1995.
