The disciplinary hearing into the case of a Manitoba Court of Queen’s Bench Justice, Lori Douglas, has been halted now and holds an uncertain future after the entire judicial panel unexpectedly announced their resignation today. The five-member committee revealed the reasons for their decision in a written manner as they alleged that public interest would not be protected if they continued to preside over a matter which has been on indefinite hold due to a long list of problems and controversies.

Previously, Douglas mentioned that any hearing conducted by a Canadian Judicial Council panel will be biased because the panel allowed an inappropriate and argumentative cross-examination of her husband, i.e. lawyer Jack King, which involuntarily exposed private details about their sex life. The incident took place in the summer of 2012, when the committee convened for the first time in Winnipeg to start the high-profile hearing. Additionally, Douglas added that the hearing will be allegedly biased because the CJC’s panel has refused to allow her lawyer to cross-examine complainant Alex Chapman about his credibility.

The written statement released today by the CJC says that it is now reviewing their options. The CJC’s executive director and senior general counsel, Norman Sabourin, stated that the “council’s mandate and duty is to ensure that the review of allegations against the judge can proceed in accordance with the provisions of the Judges Act and with Council’s By-laws in a fair and expeditious manner, in keeping with the public interest.” It was added that “in due course, another inquiry committee may be appointed in respect of Associate Chief Justice Douglas.”
