Charges Stayed against Second Accused in Anthony Smith Case

The second man posing with Mayor Rob Ford in a notorious and widely circulated photo, 23-year-old Hanad Mohamed, has been relieved of all charges laid against him, including the second degree murdered in death of Anthony Smith. Mr. Mohamed was initially charged with first degree murder and attempted murder, though the charges were later reduced to accessory after the fact to the killing of Mr. Smith, accessory after the fact to the discharging of a firearm and accessory after the fact to aggravated assault.

Mohamed was accused of driving the getaway vehicle after the slaying, which took place in March of 2012 outside a King Street West nightclub. The crown stayed all remaining charges against Mr. Mohamed in an Old City Hall courtroom on Tuesday, after which he returned to Alberta which is where he was living before his arrest.

According to Mohamed’s lawyer, Fariborz Davoudi, the Crown has mentioned in court that a thorough investigation has concluded that there was “no longer a reasonable prospect of conviction” and it “would not be in interest of justice” to proceed with the case. Meanwhile, he alleged that his client maintained his innocence and added that “I haven’t been able to get a hold of him, I’ve been trying to break the news. I’m sure he is delighted to hear it.” Davoudi alleged that “it’s been a very stressful ordeal for him.” It was added that Mr. Mohamed is a “very decent young fellow” who has hardly had any contact with the criminal justice system.
