Testifying at a Queen’s Park committee hearing into a computer wiping scandal on Thursday, Det.-Const. André Duval confirmed that OPP investigators have not found any evidence that indicates Premier Kathleen Wynne ordered public records destroyed. It was explained that experts are still in process to determine what happened to 24 hard drives that were illegally accessed by an unauthorized person in the last days of premier Dalton McGuinty.

According to Duval, the OPP investigation is currently focused on the activities of McGuinty’s former chief of staff who is suspected to have arranged the illegal access, although he did not rule out an expansion of the investigation. Duval stated that “we follow the information that the investigation will produce. If there are more people, down the road, who are involved in other criminal offences, these leads will be followed and investigated to the fullest.” In response to questions raised by the Progressive Conservatives and Liberals, Duval clarified in an unambiguous statement that Wynne’s office was not under investigation. However, he did admit that the exposed computers were vulnerable to the illegal access up until March 20, 2013, i.e. after Wynne became premier.

The OPP were asked to look into the matter after Information and Privacy Commissioner, Ann Cavoukian, discovered that public documents were illegally deleted by senior Liberal political staffers. The unlawful record deletion was unveiled by the government committee probing the costly cancellation of gas plants in Oakville and Mississauga after it sought all documents relevant to the decisions.
