Allowing Guy Turcotte to be freed on condition while he awaits a second trial in the stabbing deaths of his two children, Superior Court Justice Andre Vincent mentioned in remarks on that Turcotte’s bail will not undermine an educated public’s confidence in the justice system.
According to the 18-page judgment read aloud by Judge Vincent in a St-Jérôme courtroom on Friday, it was highlighted that “this is an illustration that the rule of law on release awaiting trial can be very different from trial law.” It was added that “a conditional release does not in any way indicate that the prisoner has been exonerated of criminal responsibility.” In addition to that, the judge alleged that “despite the public indignation and incomprehension of the actions posed, the rule of law must continue to apply, as this is the guarantee afforded us in a free and democratic society.”
42-year-old Turcotte was found not criminally responsible in December of 2012 for stabbing his two children, namely 5-year-old Olivier and 3-year-old Anne-Sophie, to death in February 2009. However, that decision was overturned by Quebec Court of Appeal and a new trial was ordered last fall. Turcotte was moved to a prison in November 2013 and has been detained at the Rivières des Prairies Detention Centre since that time. Meanwhile, he was also shifted to Philippe Pinel psychiatric hospital for some time to receive treatment for depression and is being held at the RDP facility. He has been incarcerated for a total of 57 months so far.
