A Markham man has pleaded guilty and been sentenced to two years in custody following a 2009 fatal collision between an All-Terrain Vehicle (ATV) and a mini-bike in the Town of Whitchurch-Stouffville.

On Wednesday, July 7, 2010, Iain MCLAREN, 23, of Markham, appeared before The Honourable Justice Simon C. Armstrong of the Ontario Court of Justice in Newmarket and pleaded guilty to one count of Dangerous Operation Cause Death. He was immediately sentenced to two years in custody, three years of probation, a five-year driving prohibition and was ordered to provide a mandatory DNA sample in relation to the plea. Mr. MCLAREN’s charge stems from an incident in 2009 that claimed the life of a 16-year-old male youth.

On Sunday, July 19, 2009, at approximately 9:30 p.m., an ATV driven by Mr. MCLAREN and a minibike driven by a 16-year-old male Toronto youth were travelling eastbound along the shoulder of Bloomington Road East, near the Ninth Line. Mr. MCLAREN struck the rear of the mini-bike causing both riders to be thrown from their vehicles. The youth riding the mini-bike was not wearing a helmet and suffered critical injuries. He was transported to hospital where he later succumbed to his injuries.
