President Mwai Kibaki will remain in office until June if the losing party of upcoming elections challenges the results in Supreme Court. According to the Head of Civil Service Francis Kimemia, the incumbent President legitimately stays in office until the next president takes oath.

“The Constitution in Article 142 provides that the incumbent president will continue to be in office until the next president-elect is sworn in. There will be no vacuum in terms of the Cabinet. The president is mandated to wait until he has handed over instruments of power to the next president. I want to assure Kenyans that there will be no vacuum whatsoever,” Kimemia said.

Kimemia also indicated that effective preventative measures will be taken to ascertain the security of the venue of the swearing at Nyayo National Stadium. He says the private sector will be reached out to ensure a very top notch swearing-in ceremony.

 The Constitution states that if a president-elect expires after officially being elected as president but before taking the oath, the deputy president-elect is promoted as acting president and takes the oath on the already scheduled date.

The presidential aspirants include: Deputy Prime Ministers Uhuru Kenyatta (Jubilee), Prime Minister Raila Odinga (Cord),Musalia Mudavadi (Amani), Mohamed Abduda Dida (ARK), Martha Karua (Narc Kenya), Peter Kenneth (Eagle), James ole Kiyiapi (RBK) and Paul Muite (Safina).
