The government of Maharashtra opposed the appeal filed by Kasab to consider changing his punishment from death sentence to life imprisonment on Wednesday.

The representative of Maharashtra government argued before the court that Kasab was the sole convict behind the 26/11 Mumbai attacks and was given a fair trial according to the constitution. He was never physically or verbally abused or tortured.

Gopal Subramaniam, the ex-solicitor general and the representative of the state government in this case, argued that the victim was never maltreated, tortured, or questioned in an inappropriate way during the course of his trial. He was given all constitutional rights as a prisoner and therefore his declared punishment of death sentence should proceed as announced by the state court.

The bench hearing Kasab’s appeal comprises of Justice C K Prasad and Aftam Alam. Subramaniam said, “At no point of time he was tortured or maltreated by the authorities and there has been no failure of constitutional rights given to him,” while handing over the documents that have his death statement orders. He insisted death sentence is Kasab’s only permissible means of punishment for the crime he committed.

He further added that if it had not been for Kasab being captured alive, our nation would have never found out that people from outside of India had planned the attack.

One the other hand, the lawyer appointed to defend Kasab, Raju Ramachandran Senior Advocate, stated very clearly before giving his stance before the court that he is defending the victim only because he has been appointed by the government to do so and does not wish to provoke any war against the nation by taking this case. Thereon, he argued before the court on grounds of Kasab’s age which is a major factor the court agreed to look into Kasab’s request.
