Supreme Court of India has officially asked the Center on Thursday to look into the accusations levied on the former chief justice of India Justice Balakrishnan regarding misconduct during his time as a judge.

The Supreme Court has refused to take any action against the matter and has referred the case to the government for consideration and deciding upon further course of action. The decision was announced by the bench of Justices JS Khehar and BS Chauhan. They said that if the allegations on the former chief justice are true, it is the responsibility of the President of the country to ask the Supreme Court to initiate a formal trial on the matter, with the confidence of the council of ministers. The court made the announcement that the case regarding allegations of misconduct against the former chief justice and the current chairperson of the National Human Rights Commission (NHRC) was submitted by PIL Common Cause. The allegations also specified that during this time as the chief justice of the country, his relatives are accounted to have accumulated wealth way beyond their income levels.

Enlightening about the further steps that could be taken in the case, the court said that it is dependent on the President if he decides to take the inquiry request further or puts an end to the allegations. In case he decides not to take the matter any further, he will have to inform the Common Cause, and if he decides to open an inquiry, then the matter will proceed under Section 5 (2) of the NHRC Act.
