The Supreme Court has directed the Armed Forces of the Philippines (AFP) to look into the disappearance of activist Jonas Burgos and locate the involved military personnel.

AFP chief Lt. Gen. Emmanuel Bautista is ordered to locate the officers listed in the after apprehension report pertaining to the taking into custody of Burgos last April 28, 2007. Edita, mother of missing Burgos, filed a petition urging the court to order the Court of Appeals to revive the case of her son.

“[AFP leadership should] submit to the Court a confidential report on the present and/or whereabouts of these military personnel; and ensure that these military personnel can be located and served with the processes that this Court may serve, if any,” the high court said.

The incumbent commanding officer of the 7th Infantry Division, the incumbent commanding officer of the 56th Infantry Battalion, 7th Infantry Division, and Maj. Harry Baliaga Jr. were asked to appear in the court. Lt. Col. Melquiades Feliciano was directed to file his comment on Burgos’ motion together with the recently discovered evidence within 10 days upon receipt of the resolution.

“Taking note of Mrs. Burgos’ claims that she fears for her own personal security in light of the sensitive nature of the newly-discovered evidence, the Court resolved to issue a temporary protection order in favor of the petitioner Edita T. Burgos and all the members of her immediate family,” SC spokesperson Theodore Te.
