Police Chiefs Suggest Partial Decriminalization of Small Marijuana Possession

Canada’s police chiefs have raised their voice for a partial decriminalization of possession of small amounts of marijuana, suggesting that offenders might just be ticketed and fined, but not given any criminal record. According to the Chiefs, benefits of such a step would “reduce the burden on policing and judicial resources.” Canadian Police Chiefs made this proposal at the annual general meeting of the Canadian Association of Chiefs of Police that took place in Winnipeg on Tuesday.

CACP President and Vancouver Chief, Constable Jim Chu, mentioned in a statement issued later that “the current process of sending all simple possession of cannabis cases under the Controlled Drug and Substances Act (CDSA) to criminal court is placing a significant burden on the entire Justice System from an economic and resource utilization perspective.” It was emphasized that the force does not supports complete decriminalization (or legalization) of cannabis, but it only suggests to turn possession of small amounts of pot into a ticketable offense.

In a news release issued on Tuesday, the CACP stated that it “is proposing the addition of a CDSA ticket option through the Federal Contraventions Act for simple possession of cannabis.” In the group’s news release, Chu alleged that “the CACP is not in support of decriminalization or legalization of cannabis in Canada.” He added that “it must be recognized, however, that under the current legislation the only enforcement option for police, when confronted with simple possession of cannabis, is either to turn a blind eye or lay charges. The latter ensues a lengthy and difficult process which, if proven guilty, results in a criminal conviction and criminal record.”
