A judge in Ottawa has issued an order directing the federal government to bear all legal expenses of a Department of Justice lawyer, who recently filed a lawsuit against his own department, on Friday.
The whistleblower who had recently been suspended without pay after filing his claim in December, Edgar Schmidt, points out in court documents that the government has been unsuccessful to comply with its obligations of ensuring that new legislation is in fulfillment of the Charter of Rights and Freedoms. The Federal Court Judge, Simon Noel, highlighted that the case is in public interest rather than Schmidt’s private interest, hence it was ordered that the government shall pay for all legal counsel required by Schmidt at Department of Justice rates. At the hearing of appeal, Schmidt stated that “he felt this was an issue of considerable public importance, that the interests at stake were important interests.” Schmidt is now anticipated to soon hire a lawyer to represent him, as he ably convinced the judge that he had no personal gain from the litigation.
It was confirmed by the Federal Court staff that the judge’s directive comprises of a clearly written order which is likely to be released early next week. A lawyer and the founder of whistleblower advocacy group FAIR, Joanna Gualtieri, also attended Friday’s hearing, commenting that “there is such a disparity in terms of power and resources that whistleblowers in Canada have typically been left in the gutter. They don’t have a hope generally.”
