Former Inmate Sues Government for Not Providing Needle-Exchange Programs in Prisons

A former Canadian inmate, Steven Simons, is suing the federal government of Canada for not using a proper needle and syringe exchange program in the prisons. Simons, using the help of numerous advocacy groups, has accused that this practice has kept most of the prisoners of Ottawa on a constant risk of hepatitis C and other diseases.

The lawsuit to be filed this Tuesday lists the plaintiffs to be Canadian HIV/AIDS Legal Network, HIV/AIDS Support Action Network, CATIE, the Canadian Aboriginal AIDS Network and Steve Simons. The lawsuit mentions that the federal government is accountable because of its “failure to protect the health of people in prison through its ongoing refusal to implement clean needle and syringe programs.”

Simons passed his sentence of twelve years from 1998 to 2010 in the Ontario’s Warkworth Institution, where he was infected with hepatitis C. Simons have claimed that in case there had been a proper needle-exchange program in the facility, he would not have to use the homemade and shared equipments which led to his infection.

The official statement of Simons states that “when I was in prison, I would see people passing one homemade needle around and sharpening it with matchbooks. The needle would be dirty and held together with hot glue.” Simons have clearly affirmed that his only motive is to convince a court injunction which will bind Ottawa to implement transparent needle-exchange programs in prisons across the country. The lawsuit does not ask for any sort of monetary compensation or any other punishment for that matter.

The lawsuit will be officially filed on Tuesday in the Ontario’s Superior Court of Justice. Its basis will led on the verdict that prisoners should be given a needle exchange program under the Charter of Rights and Freedoms.

  1. Hi Steven: I like the suit you made and of course I hope you are well most of all. There was a program forced into my house by the needle exchange, and welfare Ontario. It nearly killed me and I had to move out. Hope all is well.
