The Supreme Court of Canada is anticipated to soon decide on a verdict and release the judgment on Friday regarding the case of a woman who abandoned her newborn infant in a toilet bowl at a Saskatchewan Walmart store. The mother, only recognized as ADH due to a publication ban affecting the name of the baby, has stated that she was not aware of being pregnant and later abandoned the baby because she thought it was dead due to its abnormal appearance.

The highest court is now to decide on whether the defendant can be held criminally responsible for abandoning a live infant. ADH gave birth to a baby boy in store washroom in Prince Albert on May 21, 2007. The staff of Walmart soon discovered the abandoned baby on the same day, and was soon able to revive it. Consequently, ADH was placed under police custody and charged with endangering the life of a child under the age of 10 by unlawfully abandoning it.

Initially ADH was found innocent on the charges in Court of Queen’s Bench in June of 2009, after which the crown appealed the decision but it was again upheld by the Saskatchewan Court of Appeal in January, 2011. The Crown has held a stance, asserting that ADH should have at least attempted to determine whether the baby was alive before deciding to abandon it. The crown appealed the decision once again in the Supreme Court, which heard the last October.
